Judicial Review of Illegally Obtained Evidence as an Essential Guarantee of Due Process in Ecuadorian Criminal Proceedings

Abstract

The overall objective of the research was to analyze judicial review of illegal evidence as an essential guarantee of due process in the Ecuadorian criminal justice system. The research method was documentary, and its methodological approach encompassed the stages of collecting, selecting, interpreting, and analyzing texts, as well as presenting the results in a coherent manner. To this end, the study drew upon relevant and reliable sources on the subject under study, such as peer-reviewed articles. It is concluded that the proper functioning of due process in Ecuador is assessed through the control of evidence; the effectiveness of a court is not evaluated by counting how many judgments it issues or how quickly it closes cases. It is measured by its fidelity to the Constitution; therefore, excluding illegally obtained evidence and protecting the rights of the defendant is the only thing that grants a judgment true legitimacy.
